Are Christmas gifts for employees tax-free?

In Germany, Christmas gifts for employees are tax-free if all non-cash benefits in the month together cost no more than 50 Euro including VAT (§ 8 para. 2 sentence 11 EStG). This is an exemption limit: even one cent above it makes the whole amount taxable. Our cachepots up to 50 Euro are below it. For more expensive gifts such as a tabletop fountain, the employer can take over the tax at a flat rate of 30 percent (§ 37b para. 2 EStG), so that the employee pays no wage tax on it.
What applies to a gift to employees over 60 Euro?

The 60-euro limit applies only to small gifts for a personal occasion such as a birthday or wedding (R 19.6 para. 1 LStR), not to Christmas. For Christmas, the 50-euro limit for benefits in kind applies. A gift to employees over 60 Euro, such as a larger tabletop fountain, is therefore taxable unless the employer pays the tax at a flat rate of 30 percent under § 37b EStG.
What is the limit for client gifts 2026?

Client gifts are 2026 deductible as a business expense if they cost no more than 50 Euro per recipient and year (§ 4 para. 5 sentence 1 no. 1 EStG, since 2024). If you are entitled to deduct input VAT, you calculate without VAT. A STILO 21 cachepot for 54,90 Euro comes to about 46 Euro net and is therefore below the limit. More expensive client gifts such as a tabletop fire are still possible, but not deductible as a business expense.
